Second BSH Release, third BSH release, implementation phase, final evaluation and project certificate for Gode Wind 03 and Bokrum Riffgrund 03 offshore wind farm projects. The scope of services comprises project certification services in accordance with with the BSH-Standard, BSH-Nr. 7005: Standard Konstruktion, Mindestanforderungen an die konstruktive Ausführung von Offshore-Bauwerken in der ausschließlichen Wirtschaftszone (AWZ), 1. Fortschreibung 28 July 2015 – Berichtigung vom 1 December 2015 considering all phases and applicable certification modules from the second BSH release until Project Certificate.

The scope of Goods (the ‘Scope of Goods’) for the tender comprises Supply of Marine Gas Oil (MGO) or, as an option, Biofuels (HVO 2nd generation type) for vessel operating at multiple German sites. The supply agreement will be split up in delivery lots for deliveries to: Norddeich, Borkum Island, Emden/Port Knock, Eemshaven (NL) and Norderney Island. The contracting entity will provide further details in the tender documents.

Supply of Guard Vessels

Lot 1 - Interim Financial Support services as extra additional resource (consultants) needed to support a range of standardized and global financial accounting and reporting processes. Lot 2 - Corporate Tax, Tax compliance, Indirect Tax, Transfer Pricing, Tax Controversy, M&A Tax advisory, Tax advisory on rules and standards. Lot 3 - Models for financial performance management, Advisory on processes to configuration of financial budgets, Cost allocation models, ESG performance models. Lot 4 - Global coordination for assignment population, Tax compliance, reconciliation, return for expats, Payroll information to assigned population. Lot 5 - Risk management models for energy price forecast, financial funding, supply forecast and general financial risk management. Lot 6 - Advisory and coordination of activities when establishing new legal entities in new countries, Outsourced payroll and accounting services in new countries.

Ørsted Wind Power A/S intends to give its approval to the novation (transfer) of the agreement from OPUS Marine GmbH to its parent company OEG Marine Ltd. The novation is requested due to an internal restructuring of the supplier group, where we have been informed that OPUS Marine GmbH will cease trading. Further, Ørsted have been informed that all contracts and commitments with other stakeholders have been or will be transferred to OEG Marine Ltd. Based on this information, Ørsted Wind Power A/S assesses that the transfer is part of an internal restructuring of the supplier, which does not constitute a significant change of the contract as described in article 89 (1), litra d, and that Ørsted Wind Power A/S therefore can approve the novation in accordance with the public procurement rules including the principles of transparency and equal treatment as also envisaged in preamble 116 of the utilities directive. Further, the amendment is not assessed to be a fundamental change of the contract. Accordingly, Ørsted Wind Power A/S does not consider the new agreement as an agreement that has been awarded directly without conducting an EU tender procedure, but that it is a permissible amendment as described in article 89 (1), litra d.

This notice is a call for competition and supplements previously published notices from Achilles Information AS regarding the contracting entity’s mentioned in Section I use of the Achilles Utilities NCE qualification system that Achilles administer. This notice is published on a voluntary basis in order to increase transparency and knowledge about the contracting entity’s purchases in EU tender procedures. Achilles Utitlities NCE qualification system can be used for all categories of contracts relevant for Ørsted's business. This notice regards the CPV codes mentioned above. The contracting entity will carry out tenders in Achilles Utilities NCE qualification systems without further prior publication in TED and encourages any interested suppliers to register in Achilles Utilities NCE qualification system. The contracting entity reserves the right to carry out tender procedures by other means i.e. by use of more specific qualification systems published by Ørsted or by use of contract notices in TED. The CPV-codes referred to in this notice are examples of the services that can be purchased through Achilles Utilities NCE. These CPVcodes apply in parallel to the CPV-codes stated in previous notices from Achilles and Ørsted. The laws of Denmark govern the contracting entity’s use of the UNCE qualification systems and any legal dispute arising out of or relating to the use of the qualification system. Any dispute arising out of or in connection with the contracting entity’s use of this qualification system should be brought before the Danish Complaints Board for Public Procurement.

ACHILLES UTILITIES NCE is a joint qualification system for suppliers and contractors to utilities in Nordics and Central Europe. It's operated by Achilles under Article 77 of Directive 2014/25/EU. The subscribing utilities will use ACHILLES UTILITIES NCE for tenderer selection for contracts and framework agreements subject to EU procurement rules, but reserve the right to publish individual notices for specific requirements where they deem it necessary, even though they relate to the product and service categories covered by ACHILLES UTILITIES NCE. The qualification system may be used for contracts not subject to EU procurement rules at each subscriber's discretion.
